HaloGuard (“HaloGuard,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our website at haloguard.net and our Emergency Intelligence System platform (collectively, the “Service”). Please read this policy carefully. By using the Service, you agree to the practices described in this Privacy Policy.

1. Information We Collect

1.1 Information You Provide Directly

We collect information you provide directly to us, including account registration details (name, email address, organization name, job title, and phone number); organization profile data such as facility addresses, employee roster, department structure, chain of command, personnel count, and government or non-government status; location data including addresses, GPS coordinates, and job site information submitted for emergency assessments; payment information processed securely through our third-party payment processor (we do not store full credit card numbers); and any communications, messages, support requests, or feedback you send to us.

1.2 Information Collected Automatically

When you use our Service, we automatically collect certain information including device information (IP address, browser type, operating system, and device identifiers), usage data (pages visited, features used, time spent, and interaction data), real-time GPS coordinates when you or your enrolled employees use location-based features during emergency events, and log data such as server logs, error reports, and performance data.

1.3 Information From Third Parties

We receive geocoding data from third-party services to normalize your location inputs, and public hazard and emergency services data from government and public safety databases.

2. How We Use Your Information

We use the information we collect to provide, operate, and maintain the HaloGuard Service; generate AI-powered emergency preparedness assessments and risk scores for submitted locations; enable real-time GPS-correlated employee check-in and accountability during emergency events; generate HaloGuard Risk Intelligence Reports for insurance negotiation purposes; send emergency alerts, notifications, and communications to enrolled personnel; process payments and manage your subscription; provide customer support and respond to your inquiries; improve, personalize, and expand our Service; monitor and analyze usage patterns to enhance platform performance; comply with legal obligations and enforce our Terms of Service; and protect the safety, security, and integrity of our platform and users.

3. How We Share Your Information

3.1 We Do Not Sell Your Data

HaloGuard does not sell, rent, or trade your personal information or organizational data to third parties for their marketing purposes.

3.2 Service Providers

We share information with trusted third-party service providers who assist us in operating the Service, including cloud hosting providers, payment processors, geocoding services, AI infrastructure providers, and customer support tools. These providers are contractually obligated to protect your information and may only use it to provide services to HaloGuard.

3.3 Emergency Situations

In genuine emergency situations where life safety is at risk, we may share location or safety data with emergency services, first responders, or other parties as necessary to protect the safety of your personnel.

3.4 Insurance Purposes

HaloGuard Risk Intelligence Reports are generated at your request for your use in insurance negotiations. We do not share your risk data with insurance carriers without your explicit authorization.

3.5 Legal Requirements

We may disclose your information if required by law, court order, or governmental authority, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.

3.6 Business Transfers

If HaloGuard is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change via email or prominent notice on our website.

4. Data Retention

We retain your personal information and organizational data for as long as your account is active or as needed to provide the Service. If you close your account, we will delete or anonymize your data within 90 days, except where required by law. GPS location data captured during emergency check-in events is retained for a maximum of 12 months for post-incident reporting and compliance purposes, unless you request earlier deletion.

5. Data Security

We implement industry-standard security measures including encryption of data in transit using TLS/HTTPS, encryption of sensitive data at rest, access controls limiting data access to authorized personnel only, and regular security assessments and monitoring. No method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

6. Your Rights and Choices

Depending on your location, you may have the right to: access a copy of the personal information we hold about you; request correction of inaccurate or incomplete data; request deletion of your personal information subject to legal retention requirements; request a portable copy of your data; and opt out of non-essential communications at any time. 7. GPS and Location Data

HaloGuard’s core functionality relies on location data. By using location-based features of the Service, you consent to the collection and processing of GPS coordinates as described in this policy. Organization administrators who enroll employees into the platform are responsible for obtaining appropriate consent from their employees for location data collection during emergency events.

8. Children’s Privacy

HaloGuard’s Service is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us and we will delete it promptly.

9. Third-Party Links

Our Service may contain links to third-party websites. We are not responsible for the privacy practices of those sites and encourage you to review their privacy policies.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on our website with a new effective date and, where appropriate, by email. Your continued use of the Service after changes become effective constitutes your acceptance.

Please read these Terms of Service carefully before using the HaloGuard website at haloguard.net and the Emergency Intelligence System platform (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. Acceptance of Terms

By creating an account or using the Service, you represent that you are at least 18 years of age, have the legal authority to enter into these Terms on behalf of yourself or your organization, and agree to comply with all applicable laws and regulations.

2. Description of Service

HaloGuard provides an AI-powered emergency management and risk intelligence platform offering location-based disaster risk assessment across multiple hazard categories, GPS-adaptive escape route planning and recommendations, real-time employee check-in and accountability tools, a local emergency services directory, HaloGuard Risk Intelligence Reports for insurance purposes, and environmental hazard monitoring and alerts.

3. Important Disclaimers — Please Read Carefully

3.1 Not a Substitute for Professional Emergency Services

HALOGUARD IS AN INFORMATION AND PLANNING TOOL ONLY. IT IS NOT A SUBSTITUTE FOR CALLING 911 OR CONTACTING PROFESSIONAL EMERGENCY SERVICES IN AN ACTIVE EMERGENCY. ALWAYS CONTACT EMERGENCY SERVICES WHEN LIFE SAFETY IS AT RISK.

3.2 AI-Generated Information

The risk assessments, escape routes, and recommendations provided by the Service are generated by artificial intelligence based on available data at the time of the query. This information may not be complete, current, or accurate for every situation. HaloGuard does not guarantee that AI-generated assessments reflect actual conditions at any specific location.

3.3 Insurance Disclaimer

HaloGuard Risk Intelligence Reports are informational tools intended to support your insurance negotiations. HaloGuard makes no guarantee that any insurance carrier will accept or act upon a Report. HaloGuard is not an insurance company, insurance broker, or licensed insurance professional. Nothing in the Service constitutes insurance advice.

3.4 GPS and Location Accuracy

GPS-based features depend on device accuracy, network connectivity, and environmental conditions. HaloGuard does not guarantee the accuracy of GPS data and is not liable for decisions made based on inaccurate location information.

4. Accounts and Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information during registration, promptly update your account information if it changes, and refrain from sharing credentials with unauthorized third parties. You must notify HaloGuard immediately at haloguard.net@gmail.com if you suspect any unauthorized use of your account.

5. Subscription, Billing, and Payment

5.1 Plans & Free Trial

HaloGuard offers subscription plans as described at haloguard.net. New accounts receive a 14-day free trial with full platform access — no credit card required. After the trial period, continued use requires a paid subscription.

5.2 Billing & Cancellation

Subscriptions are billed monthly or annually. Annual subscriptions receive a 20% discount and are billed in full at the start of the billing period. You may cancel at any time through your account settings. Annual subscriptions canceled within 30 days of purchase receive a prorated refund for unused months; no refunds are issued after 30 days.

5.3 Discount Programs

Discount programs are available for veteran-owned businesses, K-12 schools, churches, nonprofits, and first responders. Verification documentation is required. Discounts are not stackable — the highest applicable discount will be applied.

6. Acceptable Use

You agree not to use the Service to violate any applicable law or regulation; submit false, fraudulent, or misleading information; attempt to access, tamper with, or disrupt the Service or its infrastructure; reverse engineer or attempt to extract source code from the platform; use the Service for any unlawful or harmful purpose; or resell, sublicense, or commercially exploit the Service without prior written authorization from HaloGuard.

7. Intellectual Property

The Service, including all software, AI systems, algorithms, content, design, and branding, is owned by HaloGuard and protected by patent, copyright, trademark, and other intellectual property laws. The Emergency Intelligence System is the subject of a provisional patent application filed with the United States Patent and Trademark Office. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business or personal emergency preparedness purposes only.

8. User Data and Content

You retain ownership of the data and content you submit to the Service. By submitting data, you grant HaloGuard a limited license to process and use that data solely to provide the Service to you as described in our Privacy Policy. You represent that you have the right to submit all data you provide and that doing so does not violate any third-party rights.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HALOGUARD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. HALOGUARD’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO HALOGUARD IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless HaloGuard and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with your use of the Service or violation of these Terms.

11. Termination

HaloGuard reserves the right to suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that violates these Terms or is harmful to other users, HaloGuard, or third parties. Upon termination, your right to use the Service immediately ceases.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Missouri, and you consent to personal jurisdiction in those courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website with a new effective date and, where appropriate, by email notification. Your continued use of the Service after changes become effective constitutes your acceptance.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HaloGuard regarding the Service and supersede all prior agreements, understandings, and representations.
